Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Underdog (“the App”), you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age to use Underdog. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App for your personal, non-commercial purposes. You may not sublicence, sell, reproduce, or otherwise exploit the App for any commercial purpose.

4. Acceptable Use

You agree not to:

• Manipulate or falsify health data or scores.
• Use automated tools or exploits to gain unfair advantages in leagues.
• Harass, abuse, or harm other users.
• Reverse-engineer or attempt to extract the source code of the App.
• Use the App in any way that violates applicable laws or regulations.

5. Subscriptions and In-App Purchases

5.1 Available plans

Underdog offers the following optional paid plans via Apple In-App Purchase:

Prices shown are in USD and may vary by country. The price applicable to your region is displayed at the point of purchase in the App Store.

5.2 Billing and payment

Payment for auto-renewable subscriptions (Weekly and Annual) is charged to your Apple ID account at the time of purchase confirmation. Subscriptions automatically renew at the end of each period at the same price unless cancelled at least 24 hours before the end of the current period.

The Lifetime plan is a non-consumable, one-time in-app purchase. It does not auto-renew and is not subject to the cancellation policy below.

5.3 Free trials

Where a free trial is offered, your Apple ID will be charged for the subscription at the standard rate at the end of the trial period unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited upon purchase of a subscription.

5.4 How to cancel or manage your subscription

You can cancel or manage your auto-renewable subscription at any time:

1. Open the Settings app on your iPhone.
2. Tap your name at the top, then tap Subscriptions.
3. Find Underdog and tap it to manage or cancel.

Alternatively, go to the App Store, tap your profile icon, and tap Subscriptions. Cancellation takes effect at the end of the current billing period — access continues until then.

5.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly via reportaproblem.apple.com. We do not have the ability to process refunds directly.

6. HealthKit Data

Underdog accesses Apple HealthKit data solely to provide fitness tracking features. We do not use HealthKit data for advertising, and we do not share it with third parties without your consent. Full details are in our Privacy Policy.

7. Disclaimers

Underdog is provided “as is” without warranties of any kind, express or implied. The App is a fitness and wellness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Heart rate data is for informational purposes only.

Consult a qualified healthcare professional before starting any new exercise programme, particularly if you have any existing health conditions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Underdog and its developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including injury, illness, or loss of data.

9. Intellectual Property

All content, design, and code within the App are owned by or licenced to the developer of Underdog. You may not copy, reproduce, or distribute any part of the App without prior written permission.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your licence to use the App ceases immediately.

11. Governing Law

These Terms are governed by the laws of the Republic of Lithuania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lithuania, without prejudice to your rights as a consumer under applicable local law.

12. Apple Requirements

Underdog is distributed via the Apple App Store. The following terms apply with respect to Apple:

• This licence is between you and the developer of Underdog, not with Apple Inc. Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any claims by you or any third party relating to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if applicable.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance.
